Terms of Use

Apple Standard EULA

Sundial+ uses Apple's Standard Licensed Application End User License Agreement (the “Standard EULA”), which is incorporated here by reference. These Terms supplement the Standard EULA. By downloading, installing, purchasing, subscribing to, or using Sundial+ (the “App”), you agree to these Terms and the Standard EULA. If you do not agree, do not use the App.

This agreement is between you and Tier 9 Digital LLC (the “Developer”), not Apple. The Developer, not Apple, is solely responsible for the App and its content.

License

Subject to these Terms and the Standard EULA, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Usage Rules. The App is licensed, not sold.

You may not sell, rent, lease, sublicense, redistribute, copy, modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except to the extent permitted by applicable law or applicable open-source licenses. You must also comply with any applicable third-party agreements when using the App.

App Purpose and Accuracy

Sundial+ calculates and displays solar and lunar times, phases, positions, alerts, widgets, and related data using information such as date, time, and location. The App is intended for general informational and recreational use only.

Calculations, location information, and notifications may be inaccurate, delayed, incomplete, or unavailable because of device settings, software behavior, data inputs, or environmental conditions. Do not rely on the App for navigation, aviation, marine operations, emergencies, or any other safety-critical purpose where an error could cause injury, death, property damage, or environmental harm.

Subscriptions and Purchases

The App may offer auto-renewable subscriptions, free trials, or other in-app purchases. The price, duration, and features of each offering are shown in the App before purchase. All transactions are processed by Apple through the App Store and are subject to Apple's applicable terms.

  • Your Apple Account is charged when you confirm a purchase.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period.
  • Apple may charge your account for renewal within 24 hours before the current billing period ends.
  • You can manage or cancel a subscription in your Apple Account subscription settings. Cancellation takes effect at the end of the current billing period.
  • If a free trial is offered, its length and conversion price will be shown before you subscribe.
  • Apple handles billing questions and refund requests under its policies and applicable law.

Privacy

The Sundial+ Privacy Policy explains how the App handles information. It is incorporated into these Terms by reference.

Maintenance and Support

The Developer is solely responsible for maintenance and support for the App. Apple has no obligation to provide maintenance or support. Questions, complaints, or claims about the App may be sent to contact@sundialapp.com.

Warranty Disclaimer

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available,” with all faults and without warranties of any kind. The Developer disclaims all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by the Standard EULA. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. The Developer is responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

Limitation of Liability

To the maximum extent permitted by applicable law, the Developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, goodwill, or other intangible loss, arising from your use of or inability to use the App. The limitations of liability in the Standard EULA also apply. Nothing in these Terms limits liability or consumer rights that cannot lawfully be limited or excluded.

Product and Third-Party Claims

The Developer, not Apple, is responsible for addressing claims relating to the App or your possession or use of it, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.

If a third party claims that the App or your possession or use of it infringes that party's intellectual property rights, the Developer, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.

Intellectual Property

The App and its content, features, and functionality are owned by the Developer or the Developer's licensors and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved.

Legal Compliance

You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties. You may not use or export the App in violation of United States law or the laws of the jurisdiction where you obtained it.

Apple as Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

Changes to These Terms

The Developer may update these Terms from time to time. The effective date at the top of this page will reflect the latest revision. Where required by law, the Developer will provide notice of material changes. Your continued use of the App after revised Terms take effect means that you accept them.

Governing Law

Except where the Standard EULA or mandatory law provides otherwise, these Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. These Terms do not limit any consumer rights you may have under the laws of your place of residence.
